Permago LLC ("Permago", “our”, "we" or "us") respects the privacy of our users and Permago members and has developed this privacy policy (the "Privacy Policy") to articulate our pledge and promise to protecting your privacy and to informing you of our policies and procedures concerning the personal information we receive from users of www.permago.com, www.iceberg.travel, www.icebergmeet.com, www.icebergbook.com (collectively, the "Site") and our application for mobile devices (the "Application"). We intend for this Privacy Policy to describe for you, as an individual who is a user of the Site, Application or the services offered over the telephone (collectively the "Services"), the information we collect, how that information may be used, with whom it may be shared, and your options regarding such uses and disclosures.

This Privacy Policy affects and concerns only to information that you provide to us through the Site, Application and Services. This Privacy Policy may be updated periodically. We reserve our right to update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the email address specified in your Permago Account) or by means of a notice on the Site and Application prior to the change becoming effective.

We encourage you to read this Privacy Policy carefully when using the Site, Application and Services. By accessing the Services, you acknowledge and agree that you have read, fully accept, and will abide by this Privacy Policy. Unless otherwise defined in this Privacy Policy, the terms and definitions used in this Privacy Policy will have the same meanings as in our Terms and Conditions, which can be found in the following link: https://www.iceberg.travel/terms-and-conditions.

As used in this Privacy Policy, the terms "using" and "processing" information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization or among our affiliates within the United States or internationally.

International Transfer

THE INFORMATION YOU PROVIDE US – WHICH YOU AUTHORIZE FOR PERMAGO TO TRANSFER – MAY BE MAINTAINED ON COMPUTERS LOCATED OUTSIDE OF YOUR STATE, PROVINCE, COUNTRY OR OTHER GOVERNMENTAL JURISDICTION, WHERE THE LAWS CONCERNING PRIVACY MAY NOT BE AS PROTECTIVE AS THOSE IN YOUR JURISDICTION. IF YOU ARE LOCATED OUTSIDE OF THE UNITED STATES AND DECIDE TO PROVIDE INFORMATION TO US, WE WILL TRANSFER YOUR PERSONAL INFORMATION TO THE UNITED STATES AND PROCESS IT THERE. BY CONSENTING TO THIS PRIVACY POLICY AND SUBSEQUENTLY PROVIDING PERMAGO WITH YOUR INFORMATION, YOU ARE THEREBY ACKNOWLEDGING THAT YOU AGREE TO SUCH TRANSFER.

Information Collection and Use

Permago’s main purposes in collecting information are to deliver and enhance our Site, Application and Services, to dispense and manage your use of the Site and Application, and to allow our Permago members to experience the joys and benefits of using Permago’s services.

Personally Identifiable Information

When you register and create an account with us through the Site or Application (becoming a “Member”) and when you choose to make a reservation, we will ask you for personally identifiable information. Furthermore, your Permago account and Permago member profile page may contain descriptive information about you that can be used to contact or identify you ("Identity Information"). Identity Information includes, but is not limited to, your location, name, telephone number, email address, and home mailing address, and excludes your credit card number or billing information. The Services also allows Permago members the ability to publicly or privately propose events and share other information with Permago members on Permago’s Iceberg, which may also include Identity information.

Identity and Financial information

In order for Permago to process your reservations through the Site, Application and Services, we may also ask for your credit card number, identification and other billing information ("Billing Information") (Identity Information and Billing Information collectively, "Personal Information"). We use your Personal Information to deliver the Service, manage your inquiries and fulfill your requests. As a precondition to acquiring a Permago Passport, first time users who create and register a Permago account on the Site, Application or through our Services, may be required to verify their offline identity by submitting a scan of a State-issued driver license or a government-issued Passport, in order to complete their application for a Permago Passport.

You can register to join as a member by logging into online accounts you may have with third party service providers ("SNS")(e.g. Facebook); each such account, a "Third Party Account", via our Site or Application as described below. As part of the functionality of the Site, Service and Application, you may link your Permago Account with Third Party Accounts, by either: (i) providing your Third Party Account login information to Permago through the Site, Service or Application; or (ii) allowing Permago to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account. You represent that you are entitled to disclose your Third Party Account login information to Permago and/or grant Permago access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating Permago to pay any fees or making Permago subject to any usage limitations imposed by the applicable SNS. If you decide to register by logging into a Third Party Account via our Site or Application, we will obtain the Personal Information you have provided to the applicable SNS (such as your name, email address, profile picture, names of SNS friends, names of SNS groups to which you belong, other information you make publicly available via the applicable SNS and/or other information you authorize Permago to access by authorizing the SNS to provide such information) from your Third Party Accounts and use that information to create your Permago Account and Permago Account profile page and you will become a Member. Depending on the Third Party Accounts you choose and subject to the privacy settings that you have set in such Third Party Accounts, you understand that by granting us access to the Third Party Accounts, we will access, make available and store (if applicable and as permitted by the SNS and authorized by you) the information in your Third Party Accounts so that it is available on and through your Permago Account on the Site, Service and Application. If there is information about your "friends" or people with whom you are associated in your Third Party Account, the information we obtain about those "friends" or people with whom you are associated, may also depend on the privacy settings such people have with the applicable SNS.

We also collect the other information that you provide as part of registration and the administration and personalization of your Permago Account profile (e.g., without limitation, location, individual preferences) ("Non-Identifying Information") Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your individual preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Permago members to attempt to provide you with a better experience, to improve the quality and value of the Service and to analyze and understand how our Site, Application and Service are used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your individual preferences or restrictions.

We also use your Personal Information to contact you with Permago newsletters, marketing or promotional materials and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications. Please note that we may also use your Personal Information to contact you with information related to your use of the Service; you may not opt out of these notifications.

Log Data

When you visit the Site and Application, whether as a member, Passport member or a non-member just browsing (any of these, a "User"), our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type or the webpage you were visiting before you came to our Site and Application, pages of our Site and Application that you visit, the time spent on those pages, information you search for on our Site and Application, access times and dates, and other statistics. We use this information to monitor and analyze use of the Site, Application and the Service and for the Site and Application's technical administration, to increase our Site and Application's functionality and user-friendliness, and to better tailor our Site and Application to our visitors' needs. We also use this information to verify that visitors to the Site meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.

Cookies

Like many websites, we use "cookies" to collect information. When you access the Services, we may assign your computer one or more cookies, to facilitate access to the Services and to personalize your experience. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your login information for future logins to the Site and Application. Second, we utilize session ID cookies to enable certain features of the Site and Application, to better understand how you interact with the Site and Application and to monitor aggregate usage by Users and web traffic routing on the Site and Application. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Site, Application and Service and then close your browser. Third party advertisers on the Site and Application may also place or read cookies on your browser. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered by the Services. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or Application or all functionality of the Service.

Web Beacons

Our Site and Application may contain electronic images known as Web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our Site, Application and Services are used and may be used in some of our emails to let us know which emails and links have been opened by recipients. We also may include web beacons in advertisements or promotional messages. The information we obtain in this manner enables us to customize the Site, Application and Services. It also may enable us to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming or other activities. This allows us to gauge the effectiveness of our customer communications and marketing campaigns.

Aggregate Information and Non-Identifying Information

We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain your Personal Information.

Communication via Permago Iceberg

As part of our Service, Permago members may communicate with other Permago members through our social networking platform, Iceberg, found on the Site and Application. Opinions and other statements expressed by Permago members and third parties are theirs alone, not opinions of Permago. Proposals for events or any content created by a member is the sole responsibility of that member and its accuracy and completeness are not endorsed or guaranteed by Permago. You acknowledge that by providing you with the ability to view and distribute content through our Site, Permago is not undertaking any obligation or liability relating to the content. Permago and its affiliates, successors, assigns, employees, agents, directors, and officers do not undertake or assume any duty to monitor our site for inappropriate or unlawful content. Permago and its affiliates, successors, assigns, employees, agents, directors, and officers assume no responsibility or liability which may arise from the content thereof, including, but not limited to, claims for defamation, libel, slander, infringement, invasion of privacy and publicity rights, obscenity, pornography, profanity, fraud, or misrepresentation. Notwithstanding the foregoing, Permago reserves the right to block or remove communications, postings or materials at any time in our sole discretion.

Phishing

Identity theft and the practice currently known as "phishing" are of great concern to Permago. Safeguarding information to help protect you from identity theft is a top priority. Please keep in mind that Permago will not, at any time, try to obtain your credit card information, your Permago Account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. Demographic and usage information

We collect and store demographic information, such as your gender, age, information about your interests and activities and information related to your use of the Services, such as Permago member profiles you have viewed. This information is not personally identifiable by itself, but may become so in combination with other information.

Location information

To the extent you voluntarily opt to use any of our Services that are based on the location of Permago members and which may report on those Permago members' current locations (the "Location-Based Services"), we may collect and store information about your location at the time you use those Location-Based Services. This information can come from a variety of sources depending on the client you use to access the Services; for example, a mobile phone may report its GPS location at the time the Location-Based Services are used.

Information from other sources

We may also periodically obtain both personal and non-personal information about you from affiliates, and other third parties, including third-party platforms (“Third Party Platforms”), and add it to our account information or other information we have collected.

Information about others

We may also collect and store information about other people that you provide to us, such as their name, address and e-mail address. If you use the Site and Application to send others (friends, relatives, colleagues, etc.) an invitation to join Permago, we may store any information of each such recipient that you provide us in order to process those requests or to facilitate future activities.

Information Sharing and Disclosure

The Site, Application and Service, can be used to make a reservation for Permago Virtual Assistance services. Requests and reservations for Optional Features are made available exclusively for Permago members, and made possible by authorized Permago affiliates. Work and home environments made available through Permago affiliates, and the reviews of Permago members regarding those environments, are visible to any Permago Member. Profile Information (as defined below) of Permago members, by default, is not made visible to the public, except in cases where such Permago member has chosen to change the visibility of their Permago member profile to be made public.

Generally, we may use information that we collect about you to: facilitate and enhance your use of the Services; manage your account and provide you with customer support; perform research and analysis about your use of, or interest in, the Site, Services, and content provided by us, or products, services and content offered by others; communicate with you by e-mail, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us, our affiliates or other third parties; develop and display content and advertising tailored to your interests as reflected by your use of the Services; verify your eligibility and deliver prizes in connection with contests and sweepstakes; enforce our Terms and Conditions; manage our business; and perform functions as otherwise described to you at the time of collection.

  1. Sharing with Permago Members

    When you create a Permago Account, we will set up a Permago Account profile page for you. Your Permago Account profile page will include your first name and Nationality. If you desire, you may choose other items of Personal Information to be made public (and visible) to users who are “just browsing” on the Site or Application (“Non-Members”). Other items of Personal Information that you may choose to be made public include, but not limited to – a profile picture, your age, your level of membership, your Permago location, your bed number at the Permago location, reason(s) for your travel, i.e. that you are traveling for “FUN” or “WORK” or “LOVE”, a proposal for an event for other Permago members to respond to, a list of the SNS groups to which you belong, a list of any of your SNS friends or connections who are also Permago members, connections you have established between your Permago account and any SNSs, if applicable (collectively, your "Profile Information").

    By default, we will display your Profile Information privately and only via Iceberg on our Site and Application, and, with your prior permission, on third party sites. Any information you choose to provide as part of your Profile Information will be visible to all Permago Members and therefore should reflect how much you want other Permago Members to know about you. We encourage Permago members to think sensibly about what information about themselves they disclose in their profile information page. You can review and revise your Profile Information at any time.

  2. Service Providers

    We may employ third party companies including but not limited to, our affiliates, authorized service providers, advertising companies, corporate partners, and ad networks to manage and administer parts of our Service, to provide the Service on our behalf, to perform Site and Application-related services (e.g., without limitation, maintenance services, database management, web analytics, fraud detection services relating to the activity of Permago Members and improvement of the Site and Application's features) to assist us in analyzing how our Site, Application and Service are used, or to display advertisements through the Services. These third parties may have access to your Personal Information; if they do, this access is only so that they may perform these tasks on our behalf and they are obligated not to disclose or use it for any other purpose. These companies may use tracking technologies, such as cookies, to collect information about Permago members who view or interact with their advertisements. This information may allow them to deliver targeted advertisements and gauge their effectiveness. We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. You can, at any time, opt out of receiving such communications. Third party companies, including but not limited to Google, use cookies to serve ads based on a Permago Member’s prior visits to Permago. You can disable these specific cookies that track prior visits for the purpose of follow-up advertising by opting out at http://www.google.com/privacy_ads.html.

    When you use or connect to the Site or download our Application as a mobile app by or through a Third Party Platform, such as Facebook or other social networking site, you allow us to access and/or collect certain information from your Third Party Platform profile/account (such as your Facebook account) or via any cookies placed on your device by such Third Party Platform as permitted by the terms of the agreement and your privacy settings with the Third Party Platform. We will share such information with the Third Party Platform for their use as permitted by the terms of the agreement and your privacy setting with the Third Party Platform.

    We will share some of the information we collect from you upon install of the mobile app with vendors and other service providers who are engaged by or working with us in connection with the operation of the services we provide to you and/or for analytics purposes which may require the reproduction and display of such information in an aggregated and anonymized manner such that will not in any way identify you.

  3. Authorized agents and service providers

    We may share your personal information, which may include your name and contact information (including e-mail address) with our authorized agents and service providers that perform certain services on our behalf. These services may include maintaining our servers, fulfilling subscription requests, providing customer service and marketing assistance, performing business and sales analysis, supporting the functionality of the Services, providing payment fulfillment and reconciliation services, and supporting rewards programs, surveys and other features. These agents and service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

  4. Affiliates and third parties

    When you make a reservation or engage in promotions offered through the Services, we may share personal information with affiliates and Third Party companies, with which we partner to offer you those products, services, promotions, or rewards. When you elect to engage in a particular offer or program, you authorize us to provide your e-mail address and other personal information to the associated merchant, if any. We will always provide you with the opportunity not to share information with these businesses.

  5. Compliance with Laws and Law Enforcement

    Permago cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We also may disclose your information, including personal information to government or law enforcement officials, or to our insurance services providers, or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process such as, but not limited to, a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agencies in order to: protect the property and rights of Permago, Permago affiliates or third party companies; to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity; to establish or exercise our legal rights; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

    When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce the Terms and Conditions or other agreements or policies.

    Any third parties to whom we may disclose personal information may have their own privacy policies that describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Privacy Policy. If you want to learn more about their privacy practices, we encourage you to visit the websites of those third parties. These entities or their servers may be located either inside or outside the United States.

  6. In the event of a merger, sale, or bankruptcy

    Permago may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

    In the event that we or any portion of the business represented by the Services, are acquired by or merged with a third party entity, we reserve the right, in any of these or similar circumstances, to transfer or assign any or all of the information we have collected as part of such merger, acquisition, reorganization, sale of assets or in the event of bankruptcy or other change of control.

    In the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

Links to third parties

Through the Services, you may be able to click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on a link to an external article, you may be taken to a website that we do not control. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. We recommend that you consult the privacy policies of all third-party websites you visit by clicking on the "privacy" link typically located at the bottom of the webpage you are visiting.

How you can access your information

If you are a Permago Member, you have the ability to review and update the information you have provided us by logging into your account and clicking on “Settings” under "My Passport". You also can review and update that information by contacting us at the e-mail address provided below in the "Contact" section of this Privacy Policy.

Deactivating your account

If you are a Permago Member, you may choose to deactivate your account at any time by visiting the "Settings" under your “Passport” page. After you deactivate your account, your Permago Passport will be rendered invalid and ineligible for use. We will retain your Profile information associated with your Permago account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our terms and conditions, take actions we deem necessary to protect the integrity of our web site or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties' policies.

Reactivating your account

If you wish to reactivate your Permago Account, you may submit your request by sending us an email to support@permago.com, or, by contacting us via telephone at 855-737-6246 (PER-MAGO). Restoration and approval of your Permago Passport is not guaranteed, however, you may also log in using your Iceberg Member Account credentials and reactivate your Iceberg Member Account, which is subject at all times to Permago’s Terms and Conditions.

Your choices about collection and use of your information

You can choose not to provide us with certain information, but that may result in your being unable to use some optional features of the Services. For example, such information may be required for you to: register as a Member; use Iceberg and participate in things like proposing events and responding to event proposals; participate in our Referral and/or Rewards Program and other contests or promotions we may offer from time to time; ask questions; send messages to Permago Members; or initiate other transactions on through the Services. If you are a Member, you can elect not to share any of your profile information publicly by visiting your Settings page and selecting to have your profile available only to users signed into the Services. Please note however, that this does not prevent us from sharing your information with third parties as specified above. Further, to the extent we send commercial or promotional e-mails to Permago members, you will be able to opt-out of receiving those e-mails, either in your Settings or within the body of any such e-mail. You may "opt out" of the collection of your information for third party analytics purposes by contacting us directly. If you “opt out” with our third party analytics provider, that action is specific to the information we collect specifically for that provider, and does not limit our ability to collect information from you, under the terms of this privacy policy, for other vendors. In addition, if we have already provided your information to a third party (such as a service provider) before you have changed your preferences or updated your information, you may have to change your preferences directly with that third party. We may send you, as a Member, other types of transactional and relationship e-mail communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt-out of receiving them, as our ability to communicate with you in some instances is necessary for your use of the Services as a Member. Please note that changing information in your account, or otherwise opting-out of receipt of certain e-mail communications, will only affect future activities or communications from us.

How we protect your personal information

We take appropriate security measures (including physical, electronic and procedural measures) to help safeguard your personal information from unauthorized access and disclosure. For example, only authorized employees and third parties who have agreed to be bound by confidentiality restrictions, such as consultants, may be permitted to access personal information, and they may do so only for permitted business functions. In addition, we use SSL encryption in the transmission of your sensitive personal information between your system and ours, and we use firewalls to help prevent unauthorized persons from gaining access to your personal information.

We want you to feel confident using the Services. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, searches, or other communications will always remain secure. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure e-mail. Our Policy Toward Children

The Site, Application and Services are designed for individuals over the age of 18, and are not directed to individuals under 18, nor are individuals under 18 permitted to use our Site, Application and Services. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.

No Rights of Third Parties

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Services.

Changes to this Privacy Policy

We will occasionally update this Privacy Policy to reflect changes in our practices and in the Services. When we post changes to this Privacy Policy, we will revise the "last updated" date at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by sending an e-mail to the e-mail address you most recently provided us in your account, profile or registration (unless we do not have such an e-mail address), and/or by prominently posting notice of the changes through the Services. We recommend that you check the Services from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.
